DigiCon6 ASIA Awards Terms and Conditions

28th DigiCon6 ASIA Application Guidelines

1) Purpose
The DigiCon 6 Awards (hereinafter “The Awards”) is organized by Tokyo Broadcasting System Television, Inc. (hereinafter “TBS”) to discover, select and honor excellent works by content creators in Japan and other Asian countries and regions.

2) Operation
2-1.
The Awards is operated by the DigiCon6 ASIA Awards Head Office (hereinafter “Head Office”), organized and set up by TBS. The Head Office shall be responsible for operating the contest in Japan and controlling the operation of all contests in all other participating Asian countries and regions.
Notwithstanding the foregoing, the Head Office shall set up organizers in each participating countries or regions to directly operate the local contest of the Awards in each respective countries and territories (hereinafter “Organizers”).

2-2.
The Organizers shall be responsible for and focus on

(i) operating the Awards in each respective country and region.
(ii) selecting and awarding excellent work from the works applied to the local contest.
(iii) conducting any other additional activities to add value to the Awards.

To organize and operate the Awards, the Organizers may stipulate and implement local regulations or rules that comply with or are based on this DigiCon6 ASIA Awards Application Guidelines, on its own responsibility.

2-3.
If the Head Office determines, in its sole discretion, that it is necessary for the Awards, it may take any and all necessary measures to ensure the Award’s proper operation. Neither the Organizer nor the applicants shall have the right to object to such a decision made by the Head Office.

Notwithstanding the foregoing, the above Organizers are subject to change without notice, in the event there are any changes to the participating Asia countries or regions.

3) Application of Works
3-1.
Animation works submitted to the Awards may be of any genre, style or theme, including but not limited to CG animation (2D/3D), stop motion/clay animation.
However, works must not exceed 15 minutes of length (hereinafter “Applied Work”).

3-2.
Any Applicant that is “from Asia or lives in Asia” or any Applied Work that is “created or produced in Asia” shall be eligible for application and there shall be no age limit for the Applicants.

3-3.
For application in Japan, the application period, method, and other details are provided in the "Entry Standards" included in the entry form of the Awards (hereinafter “Entry Form”).
For application from other Asian countries and regions, such information shall be as provided by each respective Organizer.

3-4.
Applicants are responsible for the submission of their works. The Head Office and the Organizers shall not be held liable for any loss or damage to the Applied Works.
The Applied Works will not be returned to Applicants.

3-5.
Applicants must hold all rights to the Applied Works, including but not limited to copyrights. If any rights are owned by a third party, the Applicant is responsible for obtaining all necessary licenses and clearances at their own expense. Copyrights to the Applied Works shall remain with the Applicants or any third party right holders.

3-6.
By submitting an Applied Works / Entry Form to the Head Office or Organizers, the Applicants is deemed to have accepted the terms and conditions hereof.

4) Judging Procedures
4-1.
The Head Office and the Organizers shall set up judging committees in Japan and in each other participating Asian country or region. These committees shall fairly judge and select superior works (hereinafter “Selected Works”) from the Applied Works, based on quality, creativity, and originality.

4-2.
The Selected Works from Japan and other Asian countries and regions shall be nominated to the final selection held in Japan. The international judging committee, organized by the Head Office in Tokyo, consisting of members of industry experts, shall select on a fair and equitable basis, the best work from the Selected Works to win and receive the awards and prizes of the contest as provided in the following Article 5.
In no event shall the Head Office and the Organizers disclose the judging standards, criteria and/or process of the Applied Works, the Selected Works, and the Award-winning Works.

4-3.
TBS and the Head Office reserve the right, in its sole discretion, to disqualify any Applicant or Applied Work from the Awards without prior notice if they are unable to contact the Applicant, or if the Applied Work contains (or have a risk of containing) any material that:

a) is offensive to public order and morals;
b) is obscene, libelous, slanderous, or defamatory; infringes upon any person’s rights; or is likely to bring TBS into disrepute;
c) violates the likeness (image rights), privacy, or credibility of any person;
d) relates to political or religious activities;
e) violates any law or is connected to illegal activities;
f) is inconsistent with the broadcasting standards of TBS or the Japan Commercial Broadcasters Association;
g) contains damaged or inaccessible data;
h) does not align with the intent or purpose of the Awards;
i) includes any errors, mistakes, or omissions in the Entry Form;
j) includes any other inappropriate contents or images;

5) Awards and Prizes
5-1.
Applicants in Japan shall apply to either category (a) or (b) below:
a) [JAPAN Awards]: Works from qualified applicants in Japan.
b) [ASIA Awards]: Award-winning works shall be selected from among the candidates, which include the winners of the [JAPAN Awards] and the winners of the respective national or regional awards organized by the Organizers set in Article 4-3.

5-2.
TBS shall determine the details of the awards, prize money, and prizes for each of the categories mentioned above; however, these are subject to change without prior notice. Furthermore, at TBS's discretion, a single work may receive multiple awards, or it may be decided that no work is eligible for an award.

5-3. (reference information)
Regarding the award-winning works from Asian countries or regions other than Japan that become candidates for the [ASIA Awards], such works are solicited and selected under the sole responsibility of the respective organizers.
The "GOLD" award winner from each region shall become a candidate for the [ASIA Awards] Grand Prize, and winners of other regional awards shall become candidates for the respective awards within the [ASIA Awards].

6) Utilization of Works
6-1.
Applicants acknowledge and agree that the Submitted Works, in whole or in part, may be non-exclusively used by TBS and any party designated by TBS, regardless of region, period, frequency of use, or type of media. Such use may include reproduction, broadcasting, cable broadcasting, public transmission (including internet and mobile streaming), screening, and distribution. Applicants shall grant a royalty-free license to TBS and its designated parties for such use, solely for the purpose of promoting and advertising the Awards.

6-2.
Regarding any use of the Submitted Works by TBS other than as stipulated in the preceding paragraph, detailed terms of use and other conditions shall be determined through discussions in good faith between TBS and the Applicant.

6-3.
Winners may not sell, assign or transfer the rights to the awards or prizes to third parties.

6-4.
TBS reserves the right to use, edit, or modify the Submitted Works at its sole discretion if it deems such actions necessary.

6-5.
TBS may freely record and use images and video footage of the Award ceremony, interviews, and other related events. Applicants or their legal guardians shall raise no objection to such recording and use.

7) Privacy Policy
7-1.
Any personal data collected from the entry form or any other documents related to the Awards may be used by TBS and the Head Office for the following purposes:

a) to contact Applicants regarding the ceremony and other information related to the Awards,
b) to include in the documents required during the selection process of the Awards to be provided to the judging committee,
c) to include in the documents to be produced upon the selection of the Selected Works and Award-winning Works,
d) to include in Awards DVDs and other media containing the Submitted Works to be distributed to introduce said works, and
e) to include in reference materials to be used in future activities of the Awards.

7-2.
TBS and/or the Head Office will not disclose any personal information submitted by Applicants to any third party, subject to the following exceptions:

a) if the Applicant provides prior consent,
b) if disclosure is required by law, court order, or requested by any government or regulatory authority, and
c) if disclosure to any subcontracting party is required.

7-3
All requests by Applicants regarding the notification of the purpose of use, disclosure, correction, suspension of use, or cessation of provision of personal information to third parties shall be submitted to the address of the Head Office provided in Article 2-4 above.

8) Notes
8-1.
Any disputes with third parties regarding the Submitted Works shall be resolved solely at the Applicant's own responsibility and expense, and shall not cause any damage or liability to TBS, the Organizers, or other applicants.

8-2.
If a breach of contract or illegal activity by the Applicant causes any damage or liability to TBS, the Applicant shall compensate TBS for such damages without objection.

8-3.
Applicants shall promptly notify TBS of any changes to the submitted information. TBS shall not be held liable for any disadvantages or damages incurred by the Applicant arising from the failure to provide such notice.

9) Prohibitions
9-1.
Applicants shall not engage in any of the following actions:

a) Impeding or potentially impeding the operation of the Awards;
b) Using the Awards for business or profit-making purposes, or preparing to do so;
c) Engaging in electioneering or similar actions, or actions that are political or religious in nature; d) Committing acts that are, or potentially are, criminal in nature or related to crimes;
e) Acting contrary to public order and morals;
f) Damaging the honor and/or credibility of TBS, jury members, or third parties;
g) Falsifying applications or other submitted documents;
h) Infringing or potentially infringing upon the property, human rights, or other rights of TBS, jury members, or third parties;
i) Disadvantaging or inflicting damages on TBS or third parties, or potentially doing so;
j) Violating or potentially violating these Rules and the Entry Standards;
k) Violating or potentially violating the laws and ordinances of Japan or other countries; or
l) Any other actions deemed particularly inappropriate by TBS.
9-2. In the event that TBS determines an Applicant to have committed any of the actions listed in the preceding paragraph, the Applicant will be immediately disqualified from the Awards and lose all rights under these Rules without prior notice or warning in any form. The same shall apply in the event that TBS is unable to contact the Applicant for a prolonged period, or if the Applicant behaves in a manner unsuited to the purposes of the Awards (including cases where inappropriate past behavior is identified).
10) Postponement and cancellation
10-1.
The Awards may be postponed, suspended or cancelled without notice in the event of any of the following:
Acts of God (including, but not limited to, fire, earthquake, tsunami, tornado, flood, meteorite, lightning strike, and incidents involving transportation systems or network systems), pandemics, amendments to laws and regulations, government measures (including state of emergency declarations issued by central or local governments), labor disputes, or other force majeure for which TBS bears no fault.

Other cases in which TBS determines it necessary to postpone, suspend or cancel the Awards due to operational reasons or unforeseen circumstances.
10-2.
TBS shall not be held liable for any disadvantages or damages incurred by the Applicant as a result of the above.
